Terms, briefly.
These terms govern your use of WinBacker.email ("WinBacker", "the tool", "the site"). WinBacker is operated by FlowStack LLC, a Wyoming limited liability company (30 N Gould St, Ste R, Sheridan, WY 82801). By using WinBacker, you agree to these terms. If you don't, please don't use it.
What WinBacker is
WinBacker is a free, browser-based tool that helps you compose and send win-back email sequences to people who have opted into your own email list. You bring your own email provider credentials (Resend, Mailgun, or SMTP). WinBacker provides the interface, the templates, and the scheduling logic. It does not send emails on your behalf from any infrastructure I control.
The tool is provided "as is"
WinBacker is provided as-is and as-available, with no warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. I do my best to make it work well, but I can't guarantee it's bug-free or that it'll always be online. If it breaks, I'll try to fix it, but I'm not obligated to.
You are responsible for what you send
This is the big one. You alone are responsible for:
- Making sure every person on your contact list consented to receive email from you. Win-back campaigns are meant for lapsed customers, not cold lists.
- Complying with every anti-spam and marketing law that applies to you — including but not limited to the U.S. CAN-SPAM Act, Canada's CASL, the EU's GDPR and ePrivacy Directive, and equivalents in your jurisdiction.
- Including a working unsubscribe mechanism and your physical mailing address in every email, where required by law.
- Handling bounces, complaints, and unsubscribes through your email provider.
- Any damage, loss, or claim caused by emails you send using WinBacker, including but not limited to deliverability problems, domain reputation damage, or legal penalties.
I don't see what you send and I can't police it. You're the sender, full stop.
Your credentials are your responsibility
WinBacker stores the API keys and SMTP credentials you enter in your browser's localStorage. I don't have access to them. If your browser is compromised, or you share a device, those credentials could be exposed. Treat them like passwords. Clear them when you're done, especially on shared computers.
Payments
WinBacker is free. If you make a payment through Stripe or any linked service, Stripe handles payment processing under its own terms; see Stripe Services Agreement.
Acceptable use
You may not use WinBacker to:
- Send spam, phishing, harassment, scams, or any content that violates any law.
- Email people who did not opt in to hear from you.
- Impersonate any person or entity, or misrepresent your affiliation.
- Attempt to break, reverse-engineer, or otherwise abuse the site, its source, or its hosting infrastructure.
- Use the tool to distribute malware or malicious links.
If we become aware of abuse, we may restrict access at our discretion, though because the tool is client-side there's limited action we can take beyond taking the site down.
Intellectual property
The WinBacker interface, copy, and original code are owned by FlowStack LLC. You're welcome to use the email templates in your own campaigns — that's what they're for. Don't repackage WinBacker as your own product.
Limitation of liability
To the maximum extent permitted by law, FlowStack LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of WinBacker, even if advised of the possibility of such damages. In any case, FlowStack LLC's total aggregate liability for any claim relating to WinBacker shall not exceed the greater of (a) the amount you paid FlowStack LLC in the past 12 months (which, since the tool is free, is typically $0), or (b) fifty U.S. dollars.
Indemnification
You agree to indemnify and hold FlowStack LLC harmless from any claims, damages, losses, or costs (including reasonable legal fees) arising from your use of WinBacker or your violation of these terms, including but not limited to any emails you send using the tool.
Changes to these terms
We may update these terms occasionally. The "last updated" date at the top shows the latest revision. If changes are significant, we'll try to flag them on the site. Continuing to use WinBacker after changes means you accept the new terms.
Termination
You can stop using WinBacker anytime — just close the tab and clear your data. We may also discontinue the tool at any time, for any reason, without obligation.
Governing law
These terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA. Any dispute arising from these terms shall be resolved informally first, by direct communication. If a formal dispute is necessary, any action shall be brought in the courts of Sheridan County, Wyoming.
